Dubai Court orders Heart of Europe developer to refund Dh1.5m to investor

The Dubai Court of First Instance ruled against Kleindienst Group after the developer failed to register a unit at the Heart of Europe project.

The Dubai Court of First Instance has ordered the developer of the Heart of Europe project to refund Dh1.5 million to an investor following a breach of contract. The ruling follows the developer’s failure to transfer the title deed for a property purchased within the offshore development at The World islands. The court directed Kleindienst Group, the project developer, to return the full purchase price of a unit located in the "Germany" villa section. In addition to the Dh1.5 million refund, the developer must pay a 9% annual legal interest on the amount, calculated from the date the lawsuit was filed until the payment is settled in full. Contractual breach and registration failure The dispute arose after the investor fulfilled all payment obligations for the property but did not receive the official title transfer. Evidence presented in court confirmed that the developer failed to register the unit in the Dubai Land Department (DLD) real estate register, a mandatory legal requirement for completing property transactions in the emirate.
